Terms of Use — White Noise App

1. Acceptance of Terms

By downloading, installing, or using the White Noise mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the App.

2. Description of the App

White Noise provides users with a library of relaxing sounds (such as rain, forest, white noise, and other ambient audio) to help improve focus, relaxation, or sleep quality. Some features may be available only through a paid subscription.

3. Eligibility

You must be at least 13 years old (or the minimum age required by your local laws) to use the App. By using the App, you represent that you meet this age requirement.

4. Subscriptions and Payments

4.1. In-App Purchases

The App may offer paid subscriptions or one-time purchases.
Payments are processed exclusively through Apple App Store using your Apple ID account.
We do not have access to your payment information.

4.2. Renewal and Cancellation

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel your subscription in your Apple ID settings.
Refunds are handled in accordance with Apple’s refund policy.

4.3. Free Trials

If you start a free trial and do not cancel before it ends, your account will be charged for the chosen subscription period.

5. License to Use the App

We grant you a personal, non-transferable, non-exclusive license to use the App solely for personal and non-commercial purposes in accordance with these Terms. You may not:

Copy, modify, reverse-engineer, decompile, or disassemble the App;
Use the App for commercial purposes, resale, or distribution;
Attempt to access or modify source code or back-end systems.

6. User Conduct

You agree not to use the App in any way that:

Violates applicable laws or regulations;
Interferes with the functioning of the App or servers;
Attempts to gain unauthorized access to systems or user data.

7. Intellectual Property

All content within the App — including sounds, graphics, text, icons, and code — is owned or licensed by CosmoApps and protected under copyright and trademark laws. You may not reproduce or distribute any content without prior written permission.

8. Third-Party Services

The App may integrate with third-party services such as Amplitude, Adapty, Firebase, and AppsFlyer for analytics and performance monitoring, and with Apple App Store for payment processing. We are not responsible for any actions or data practices of these third-party providers. Use of their services is governed by their respective terms and privacy policies.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without any warranties of any kind, express or implied. We do not guarantee that:

The App will be error-free or uninterrupted;
Sounds or features will meet your expectations;
Data or analytics provided will be accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, CosmoApps shall not be liable for any indirect, incidental, or consequential damages, or any loss of profits, data, or goodwill resulting from use of the App. Your sole remedy for dissatisfaction with the App is to stop using it.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, if you violate these Terms or misuse the App. Upon termination, your right to use the App will cease immediately.

12. Changes to the Terms

We may update these Terms of Use from time to time. The latest version will always be available within the App or on our website. By continuing to use the App after changes are published, you accept the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of your country of residence (or the jurisdiction specified by the App Store where you downloaded the App), without regard to conflict of law principles.
